Residential ▪ Commercial
Landlord/tenant obligations are usually spelled out in written leases. Tenants are supposed to pay the rent on time, keep the premises and the surrounding area clean and in good condition, and generally treat the rented premises the way they would treat their own property. The landlord of residential premises is supposed to provide a clean apartment when the tenant moves in; clean common areas (hallways, stairs, yards, entryways); assure well-lit hallways and entryways; and provide properly working plumbing and heating.
Residential leases are standardized documents, for the most part, and their terms are meant to cover most exigencies.
There is theory - and then there is real life.
Written leases are necessary, but are not always enough to guarantee that residential landlords and tenants do what they are supposed to do. Tenants sometimes do not get what they bargained for - and sometimes they try to seize more than they deserve.
Property owners of residential properties routinely ask for our help with evictions because of their tenants' violations, including:
- Nonpayment of rent
- Lapse of time (expiration of lease)
- Nuisance behavior
- Other substantial breaches of lease
